Hi,
One of my friends lost his Petition papers. His H1-B visa is about to expire and he wants to file for an extension. Currently he is in India and was planning to travel to US this week, when he lost his petition papers.
Will it be possible for him to travel to US without his Petition papers and apply for a duplicate / extension?
Please let me know any help line number where he can call to clarify his doubts.

While I certainly feel somewhat bad for Mr. Downey, this short exchange gave the impression that nothing similar would ever happen in America! Hah!
U.S. Immigration Law contains restrictions that bar entry to people forever, for virtually any youthful indiscretion they have ever had, e.g. simple possession of a marijuana 20 years ago, without regard to whether or not you were actually convicted of the crime! You do not even need to have been convicted; the fact that you admit you did it will also get you barred from entry. Heck you will even be bounced (http://www.markshuttleworth.com/archives/43) from the United States after overstaying your visa for one day, leaving one day late, and then trying to come back in on that visa. So, if you were watching David Letterman and thanking your lucky stars that America is far nicer to arriving tourists than Japan--think again!

I was going through the processing times bulletin which they normally release around 15th of every month and noticed that though date at top says (Posted: September 28, 2008 ) but before the list starts they have written
.................Service Center Processing Dates for Nebraska Service Center as of: July 31, 2008.
Now what is that, have they lost track of dates being considered as of today.............. I can understanb things might standstill for I-485 (dues of non availability of visa numbers), but what about I-140, for last few months it does not jumpout of that March shell.
Also what do they mean by as of July 31, 2008, can we not know someohow as of October 8th or September 28th, what cases are they considering .

My I140 was originally filed at California service center, on 3/24/2006 it was transferred to Texas service center.

I am a July 07 filer. Recently I sent in EAD renewal application and got it approved within a month. When I saw my EAD card the Sex category on it was F instead of M. Now what are my option. Should I reapply for EAD or continue working on it. I changed my employer last month and am currently working on EAD.

My attorney office replied back to My I485 query yesterday in the overnight post(today is the last day to respond). For the marriage proof, i attached the marriage certificate which has my incorrect date of birth. I attached the affidavit describing that there is the entry error in the marriage certificate and applied for the correction and as in process with "Registrar of Marriage" office in India. In the meantime, i received the corrected marriage certificate today with the scanned copy. My question is, Can i send my corrected marriage certificate document today to USCIS ? Will they accept with one day delay?

To everyone who reads my post. I apologize for not being clear. The article says that they are talking about eliminating the per country caps and giving green cards to STEM graduates. In my haste and excitement I should have spelled this out. Now with that said I do not appreciate the snide remark from the previous poster. I believe you should be using your EAD + AC21 after 6 months of filing 485.
did you check elsewhere in the forum, I have seena lot of communication about it before here.

you can use AC21 with H1 transfer also. Using EAD is not mandatory.

Hi all,
I think my scenario is little complicated.I have my I140 (EB3) cleared with previous employer and my current company has filed new labor and I140 (EB2). They are trying to capture the priority date of my old I140 approval (August 2006).
While my current I140 is still going on, can I apply for I1-485 due to sudden improvement shown for EB2 category in September Visa bulletin.
Please advice.

Do it as soon as you can. You have a lot of time though. This year's quota started from April 1 which will come into affect on oct 01. You have nothing to worry.

Hey,
I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.
Hope this helps. I understand this might not be the case for all but it worked for me.

Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is
1.will that affect my H1-b transfer?
2.will USCIS go back that far to verify my paystubs?, and

I am in similar situation. If she comes here and we get married "new" and I am GC Holder can she get a GC too ( provided PD is current ) OR I have to wait till I become Citizen and then file ....
